Answering questions asked by the police, rarely helps anyone. There may be exceptions, but the Police too often use any answer to trap even innocent people.
You have the right to remain silent. Use it.
Remember, the police make their money by arresting people and assisting prosecutors. The Police are Legally Authorized to Lie during an "Investigation". The police are trained to lie. They lie all the time. If you lie to them, or if they somehow trap you into making a mistake about what you tell them, they will prosecute you for your mistakes.
WARRANTLESS SEARCHES - DO NOT EVER CONSENT TO A SEARCH OF YOUR PERSON, CAR OR HOME.
Do not consent to search. But do not physically resist. If the police insist on searching you, keep repeating that you do not consent to the search. It is best to have someone at a safe distance from the cops videotape the interaction with cops on their phone. This can later be used in court against the police. Remember the police lie all the time, they don't want to be caught on tape lying. They may become violent with you, so if you can secretly record them, that is best. COPS ARE TRAINED TO LIE. They can, you can't. Don't answer their questions. Keep repeating I will not answer any questions without a lawyer.
Tell the Officers that you want to contact your lawyer before answering any questions.
Ask to see a lawyer as soon as any questioning starts.
NEVER ALLOW THE POLICE INTO YOUR HOUSE FOR ANY REASON UNLESS THEY SAY THEY HAVE A WARRANT. THEY DO NOT HAVE TO SHOW YOU A WARRANT.
Do not just open the door unless they say they have a warrant. They may lie about this too, so get it on video and audio tape. It is perfectly legal to video and audio tape police as long as you know it is being filmed and taped. The police don't have to be told they are being taped in Nevada, so don't tell them. That way you can catch them in multiple lies in some cases. But don't invite the police in your house without them having a warrant.
The police sometimes get a telephonic warrant. So they can't or won't show you a piece of paper. If they say they have a warrant, let them in. A lawyer can try to sort out their lies and half truths later. They may force their way in - so don't physically resist and remember to film the interaction and bring the videotape to me at DAVID OTTO LAW. I have success suing Metro for police brutality.
ALWAYS VIDEO TAPE THE POLICE. DO IT IN SECRET IF YOU CAN, IF THEY ARE ON YOUR PROPERTY OR IN PUBLIC, WHERE THE COPS HAVE NO REASONABLE EXPECTATION OF PRIVACY - IT IS PERFECTLY LEGAL TO VIDEOTAPE THEM. IT IS PERFECTLY LEGAL TO AUDIOTAPE THEM AS LONG AS YOU KNOW THAT YOU ARE BEING TAPED.
DO NOT TAPE ANYONE ON THE PHONE WITHOUT OBTAINING THEIR CONSENT BY INFORMING THEM THAT YOU ARE TAPING THE CONVERSATION.
You can not legally audiotape anyone on the phone without informing them that you are taping, but video cops on your property or in public is perfectly legal unless they have an expectation of privacy. This means no taping in changing rooms, locker rooms, or bathrooms while anyone is doing anything private. But if a cop comes into you house he or she is tacitly allowing you to videotape your interaction with the cop.
You can videotape a traffic stop. If you're stopped while driving or a passenger, keep the video running in your hands or place it in a cup holder tilted up toward where the cop is. Remember, cops are trigger happy and they will shoot you for no reason and then claim you made a 'furtive' movement. Keep your hands visible as the police approach the car. Don't mouth off. Don't consent to a search. Keep the video running. Cops are now saying they thought the phone was a gun (remember all they do is lie) so turn on the video and put it in the cup holder of your car or some other place where it can get a partial shot of the cop. You can politely ask for the cop's name and badge number. Don't tell the cop your videotaping. Surprise them later. If know you're videotaping they may try to destroy the evidence. I've seen that more than once.
WHY YOU SHOULD BE POLITE.
Because the cops are a dangerous bunch. And they lie. So don't provoke them.
