Stop Foreclosure
If you have been served with a Foreclosure Notice, you need
to hire a lawyer right away, if you can.
Most of the many foreclosures in Nevada are done as 'Non-Judicial Foreclosures'. This means your Deed of Trust or your 'Mortgage Instrument' allows the lender to foreclose without bringing you to Court. They simply notice you of the Foreclosure, follow the methods laid out in Nevada Law and the mortgage documents and evict you from your home.
There are certain defenses to Foreclosure. Not all of them will work, and not all of them will work all the time, but they will at least give you an opportunity to see if your lender's documents are in order, to see if they actually own the note, which allows them to foreclose on you.
The litigation process, while it determines who the real owner of the note is, will allow you the time to plan your next move.
